A court has ordered the prompt discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing detainment is without legal authority.
"Since his release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The situation originates in a mistaken deportation to El Salvador earlier this year, which the government later acknowledged was an error. After his return to the United States to face human smuggling allegations, he was detained in immigration detention.
In her order, the court pointed out that the government does not have a valid deportation order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
The legal challenge involve conflicting claims. Whereas the former administration contends that Abrego Garcia is a affiliate of the MS-13 criminal organization, he vehemently denies this allegation.
He has also entered a not guilty plea to the smuggling charges, which are part of a separate criminal case in the state of Tennessee.
The judge, who was hearing his petition to deportation in a federal court, determined that he must now comply with the terms of his release from custody in Tennessee. This decision effectively transfers his supervision to the Tennessee court.
